International SMS Banned by TRAI..
It was a burning issue for those who
were subscribed in NCCPR that they are getting unsolicited commercial
SMS through the international route with dynamic sender ID. Now TRAI has
been taken care of those issues by issuing a notice to all those
operators that all international bulk sms should be blocked within next
30 days. Now it is hard time for those who had purchased bulk quantity
of international sms for promotion / transactional. They will surely
lose those credits and will be forced to switch Indian gateway.
Our management has the right forecast
and stick with the Indian SMSC as per the regulation of TRAI to avoid

Prepaid SMS Credits recalculated as per new TRAI regulations
Dear Valued Customer,
As per our previous communication, you may be aware that on the evening of October 25 TRAI released a new regulation concerning sending of promotional messages. In TRAI’s on-going efforts to significantly curtail promotional SMS, they have announced that all such messages will be subject to a 5 paise+Tax fee per message. A copy of the regulation can be accessed in the link provided below

We have subsequently been informed by all of our operator partners that this charge will be effective October 25.
Consequently, for our customers who are on prepaid basis and sending promotional messages the existing price has been increased by 5P and accordingly their available sms credit is reworked.
Please take a note of the same and let us know in case of any queries.

Eventually, after a long controversy, wait & confusions NCCPR (National Consumer Preference Register) scheduled to go into effect on the 27th Sep 2011, in this regard it is important to understand how these guidelines change the way we operate.
Messages can be classified as two
- Transactional Messages
- Marketing/Promotional Messages
Transactional Messages
“Transactional message” means an SMS containing only—
- Information sent to its customer(s) by the Bank or financial institution or insurance company or credit card company
- Information given by Airlines or Indian Railways or its authorised agencies to its passengers regarding travel schedules, ticket booking and reservation;
- Information from a registered educational institution to parents or guardians of its students;
Marketing/Promotional Messages
“Promotional message” means message containing promotional material or advertisement of a product or service
Message Submission Timings
As per new regulations, no telemarketing (Voice Call or SMS) is permitted between9.00 PM to 9.00 AM to any mobile subscribers strictly irrespective whether the number is registered with NCCPR Registry or not.
Changes : Messages would not accept after 9 PM till morning 9 AM.
Sender ID/Header for promotional Messages
From 27th Sep 2011 onwards dynamic Sender ID would not be provided for any customers for sending marketing/promotional messages. Instead of Dynamic Sender ID we will provide you with a unique 5 digit number assigned by Operator to us

‘-‘ is the delimiter
‘1’ defines the category of promotional message from 1-7 of partially blocked category
‘54234’ indicates five digits allocated to us by our operator

Transactional Gateway will be allocated only to following category of business
- Registered Companies
- Registered Banks & Financial Institution
- Insurance Company
- Credit Card Companies
- Registered Education Instituted (Only for sending information to parents)
- Airlines & Railway (Only for sending ticket & PNR details to passengers)
Only API Access will be given for sending transactional message with max 2 Sender ID’s (Subjected to Approval)
Changes: From 27th Sep 2011 onwards all allocated NON-DND route will be terminated and scrubbed against NCCPR Registry. We will be sending more details and documents required within a week to allocating transactional route.

TRAI UPDATE
Updated: India’s SMS Spam Regulations To Be Applicable On 27th September 2011
Updated below: This just in: the SMS Spam regulations for India will be applicable on the 27th of September 2011, according to a notice from the Telecom Regulator TRAI. This follows an earlier statement from Telecom minister Kapil Sibal last month, that SMS Spam – rather, the incessant unsolicited ‘mobile marketing’ via Bulk SMS providers – will end within six weeks. Looks like he intends to keep his word, though the regulations have been postponed on a number of occasions in the past (see below).Download the new regulations here. We hope that some common ground has been found between the very restrictive regime proposed last year, and the NDNC which has so far failed to protect customers from being bombarded with spam (for example, I’ve got 17 spam messages over the last two days, mostly from LM and DM numbers)
Highlights of the Sixth Ammendment:
- Every Access Provider shall withdraw before the 26th September, 2011 all telecom resources allocated to a telemarketer except those telecom resources which have been allocated in accordance with the provisions of the regulations.
- The DoT has provided the ’140’ number series to be allocated to telemarketers for fixed line network. Access Providers have to make relevant provisions in their network before
allocation of resources to telemarketers using ‘140’ numbering series from fixed line network.
- A customer may exercise his option to receive messages for the following preferences: 1- Banking/Insurance/Financial products/credit cards, 2- Real Estate, 3- Education, 4- Health, 5- Consumer goods and automobiles, 6- Communication/Broadcasting/
- Every Access Provider shall ensure that any commercial communication including SMS, other than transactional messages, is sent to a customer only between 0900 Hrs to 2100 Hrs.
- The Authority has also modified the definition of transactional messages considering the practical aspect of business, and has included banks, insurance companies, securities and other financial institutions as well as DTH operators under the category.
- Public authorities who wish to send SMSs in public interest can be exempted from the regulations.
- For sending the promotional messages, the telemarketers will use an alphanumeric identifier in the format XY-RZZZZZ where X stands for code allotted to Access provider, Y stands for service area, as specified by the Authority from time to time and R being any digit from 0 to 7, where 0 indicate that the SMS is commercial communication and ZZZZZ indicates five digit unique identification code allotted to telemarketer by the Access Provider. As and when additional preferences are specified by the Authority, the same will be assigned number 8 onwards for ’R’.”
- No Access Provider shall permit sending of more than one hundred SMS per day per SIM or three thousand SMS per month per SIM.
- The Authority may by direction, from time to time, specify the category of SMS which shall be excluded from the limit of one hundred SMS per day per SIM, provided the customer gives an undertaking to the access provider that he shall not use such telephone number for sending any commercial communications and the provider shall enter, in the listmaintained in the National Telemarketer Register, the telephone number, name and address of such customers.
- A customer can change his preferences in the NCPR after seven days of making any changes. This was previously kept at three months.
